I won't argue that point that perhaps he could have warned him first, but like I said "hind sight is 20/20". Massey was (by what I can tell) already towards the back of his vehicle. He (the officer) had to think and react quickly. He did what he did. If someone on the street puts a gun to your head and says "don't move and give me your money" are you going into "survival mode" by walking to your vehicle or are you going to do what you're told. This guy was ignorant and wanted control. He lost.

Every time I approach my vehicle, I have a reflex action to feel for keys in my pocket. Could it be that other people besides me do that too? Like Massey explained on tv, he was in survival mode. He honestly thought Gardner was pointing a gun at him. Massey was just calmly speaking to the officer, and the next thing he knows, his life is being threatened. Maybe "you're under arrest" would have helped? Maybe "Sir, I'm going to tase you if you don't comply" might have been the right thing to do?

A young clean cut father should know to obey the officer. Period. Also, I noticed Massey had his hand in or near his front pocket AS HE REFUSED to stop and place his hands behind back. Until you live the life, you have no idea what people are capable of doing and how (extremely) fast a "normal" situation can go south. If you listen to the end of the conversation where the officer is talking to his wife, he explains everything pretty clearly.

This driver, Massey, explained on national tv that he was completely confused when he saw Gardner screaming and pointing what he thought was a pistol at him. He actually thought Gardner had completely gone insane. Gardner did not WARN him that he would tase him. So Massey's desire to live kicked in, and he began to walk back to his car. You know, survival reaction, go back with your family to protect them and yourself?! This was extremely traumatic for Massey's whole family.

Yes, it is the law to do what you are told. That's why we have attorneys, to fight for any violations guaranteed you in the 4th amendment. |
